Union Minister Ashwini Vaishnaw on SC/ST Reservation: “No Provision for Creamy Layer in Ambedkar’s Constitution”

Union Minister Ashwini Vaishnaw addressed the ongoing discourse on reservation policies following a Supreme Court judgment and subsequent Cabinet discussions. In a statement, Vaishnaw emphasized that the National Democratic Alliance (NDA) government remains committed to upholding the principles established by Dr. B.R. Ambedkar in the Indian Constitution.

“The Supreme Court has delivered a judgment regarding reservation and provided suggestions concerning SC and ST reservations,” Vaishnaw noted. “Today, we had a detailed discussion in the Cabinet about these issues.”

Vaishnaw highlighted that the Constitution, as framed by Dr. Ambedkar, does not include provisions for a ‘creamy layer’ within the SC and ST reservation categories. “The NDA government is firmly bound by the Constitution created by Dr. Ambedkar. According to this Constitution, there is no provision for a creamy layer within SC and ST reservations,” he said.

The minister’s remarks come in the wake of increasing debates and judicial scrutiny over reservation policies and their implementation. The Supreme Court’s recent judgment has reignited discussions about the scope and application of reservations for Scheduled Castes (SC) and Scheduled Tribes (ST).

Vaishnaw’s statement underscores the government’s stance on adhering to the original framework of the Constitution regarding reservation policies. The absence of a creamy layer provision means that the benefits of reservation are intended to reach all individuals within the SC and ST communities, without exclusions based on socioeconomic status.

The Cabinet’s discussions reflect the ongoing efforts to address and clarify issues related to reservation policies, ensuring alignment with constitutional mandates and the principles laid down by Dr. Ambedkar. As debates continue, the government’s approach will be closely monitored by various stakeholders and communities affected by these policies.
